I agree with spoonzie's view too that many search engines list files/locations of files
that infringe copyright law....why then are they not chastised or punished for this....simply as you say...they have more money and bigger sponsorship, hence able to fight a stronger legal battle (plus it *may* be possible that peoples share prices would be hurt and that just wouldnt do old boy!)
example again....type into any search engine the exact phrase "spiderman" + "torrent" and see what comes up.....surely then, this search engines owners/operators should be punished for linking such outrageously lawbreaking results!!

i would have to intentionally search for 'illicit' material by typing in the search phrase above....the search engine itself only lists what i have asked it to with no intent to diseminate the linked material illegal or otherwise....its a collation tool....tv-links.co.uk pro-actively lists these links with the intent to diseminate the linked content.
basically im playing devils advocate....im a big believer in free speech and free thought....without people stretching the bounds of 'legal' we probably wouldnt have the net....better operating systems...faster and better hardware (can you spell reverse engineering?).

my honest personal opinion? support these guys as much as you can....its a small nail, but it will help keep the coffin lid in place if it gets hammered home.

Sin and everyone over at tv-links did nothing illegal , all they did was post links in a place for everyone to see them .. they didnt actually host any of the files and from what i gather they didnt upload any either. the grounds on which they were arrested are very flakey and seem more like a pr stunt than an actual attempt on the people responsible for the copying.
if they are found liable for anything then i think it sends a bad message as if they can be arrested for linking then surely thats wrong ... and if you continued with their chain of thought, google links you to all sorts of illegal things should you search for them. so does that make google in the wrong .. to be honest its ridiculous that they took it down and i hope it comes back up soon :<

The latest info I have is that the Gloucestershire police have confirmed that the arrest was made under section 92 of the Trade Mark Act, on suspicion of supplying property with a registered trademark, without permission.

out-law.com seems to thinks that; "While FACT's statement cited "offences relating to the facilitation of copyright infringement," Gloucestershire police told IT news site The Register that the man has been "arrested for supplying property with a registered trade mark without permission."

The first of these is not an offence and the second does not fit the circumstances, according to Kim Walker, head of intellectual property at Pinsent Masons, the law firm behind OUT-LAW.COM.

"We don't have an offence in the UK for facilitation of copyright infringement," said Walker. "Instead, it is possible that prosecutors could attempt to characterise this as an offence of 'distributing' infringing copies or 'communicating' copies to the public in the course of a business."

"If TV Links carried advertising, it's arguably a business. If it didn't carry advertising, it can still be criminal if the site can be shown to affect the copyright owner in a prejudicial way," he said.

The offence carries a maximum penalty of 10 years' imprisonment – though Walker said the provision of links has never before been classed as a form of distribution or communication in terms of the legislation.

The use of trade mark laws to prosecute the individual seems an even bigger challenge, he said. "The Trade Marks Act makes the unauthorised use of trade marks in relation to goods an offence; but this is a law that was written to catch counterfeit goods," he said.
